Welcome to YAKA Nation. These Terms of Service govern your access to and use of www.yakanation.com.au, including purchases made through our online store.

By accessing our website or placing an order, you agree to these Terms to the extent permitted by applicable law. Please read them carefully before using our website or purchasing a product.

1. About YAKA Nation

This website is operated by YAKA Nation (ABN 95 323 524 209).

Throughout these Terms, “YAKA Nation”, “we”, “us” and “our” refer to the business operating www.yakanation.com.au.

YAKA Nation currently accepts orders for delivery within Australia only.

2. Eligibility

By using this website or placing an order, you confirm that:

  • You are at least 18 years old or have permission from a parent or legal guardian.

  • You are legally capable of entering into a binding agreement.

  • The information you provide is accurate, current and complete.

  • You will use the website only for lawful purposes.

3. Products and Availability

We take reasonable care to ensure that product descriptions, images, colours, measurements, materials, prices and specifications are accurate.

Colours may appear differently depending on screen settings. Minor variations may also occur because of normal fabric cutting, sewing, printing and finishing processes. Applicable garment measurement tolerances are disclosed in our product information or Size Guide.

Product availability may change without notice. Adding a product to your cart does not reserve that product.

We may update products or specifications offered for future purchase. Any material change affecting an accepted order will be communicated to the customer before fulfilment.

4. Pricing and Taxes

All prices are displayed in Australian dollars (AUD).

Any applicable taxes will be included or shown at checkout. Delivery charges are additional unless complimentary delivery applies and will be displayed before the order is submitted.

Prices and promotional offers may change before an order is placed. The price applying to an accepted order is the price confirmed at checkout, subject to the correction of genuine and obvious errors.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

Receiving an automated acknowledgement does not necessarily mean that an order has been accepted. An order is accepted after payment has been authorised and we issue an order confirmation.

We may refuse or cancel an order where:

  • A product is unavailable.

  • Payment cannot be authorised.

  • Delivery information is incomplete or invalid.

  • There is a genuine and obvious pricing or product-information error.

  • We reasonably suspect fraud, unauthorised activity or commercial resale.

  • We cannot legally or reasonably fulfil the order.

If we cancel an order after payment has been received, the amount paid for the cancelled products and any applicable delivery charges will be refunded to the original payment method.

6. Payment

Payment must be authorised before an order can be processed.

Payments are handled securely through Shopify and its supported payment providers. YAKA Nation does not store complete payment-card details.

Available payment methods are displayed at checkout and may change from time to time.

7. Shipping and Delivery

Shipping destinations, flat delivery charges, order-processing times and estimated transit times are set out in our Shipping & Delivery Policy:

Delivery estimates begin after dispatch and are provided as a guide. Regional or remote destinations and circumstances outside our reasonable control may affect delivery times.

Customers are responsible for providing complete and accurate delivery information. We will make reasonable efforts to assist with address corrections requested before dispatch, but changes may not be possible after an order has entered processing.

If we cannot supply an order within the promised timeframe or within a reasonable time, we will provide an appropriate solution in accordance with Australian Consumer Law.

Risk in the goods passes to the customer when the order is delivered to the nominated delivery address or an authorised delivery location.

8. Order Cancellations

If you wish to cancel an order, contact enquiries@yakanation.com.au as soon as possible.

We will make reasonable efforts to process the request, but cancellation may not be possible after an order has entered processing or been dispatched.

Nothing in this section limits any cancellation right available under Australian Consumer Law.

9. Returns, Exchanges and Refunds

Returns, exchanges, change-of-mind requests and refunds are governed by our Returns & Refund Policy:

Our goods come with guarantees that cannot be excluded under Australian Consumer Law.

If a product has a major failure, you may be entitled to choose a refund or replacement and may also be entitled to compensation for other reasonably foreseeable loss or damage.

If a product does not meet a consumer guarantee and the failure is not major, you may be entitled to have the problem remedied within a reasonable time.

Change-of-mind returns are separate from your rights under Australian Consumer Law and are subject to the eligibility requirements stated in our Returns & Refund Policy.

We may request reasonable proof of purchase and may assess a returned product before providing a remedy. Any return-authorisation procedure does not limit your statutory rights.

Nothing in these Terms limits or excludes any rights or remedies available under Australian Consumer Law.

10. Promotional Offers

Promotions, discount codes, complimentary-delivery offers and bundles may be subject to additional conditions disclosed at the time of the offer.

Unless otherwise stated:

  • Promotional offers cannot be exchanged for cash.

  • Offers cannot be transferred.

  • Offers cannot be combined with another promotion.

  • Eligibility requirements must be satisfied when the order is submitted.

We may change or withdraw an offer before an eligible order is accepted. Changes will not affect an order already accepted under that offer.

11. Customer Accounts

Where customer accounts are available, you are responsible for:

  • Providing accurate account information.

  • Protecting your account access and verification codes.

  • Preventing unauthorised access to your account.

  • Notifying us promptly if you believe your account has been accessed without permission.

We may suspend access to an account where reasonably necessary to protect the customer, YAKA Nation or other users from suspected fraud, misuse or security threats.

12. Reviews and Customer Content

If you submit a product review, photograph, comment or other content to YAKA Nation, you confirm that:

  • The content reflects your genuine experience or opinion.

  • You have the right to provide the content.

  • The content does not infringe another person’s rights.

  • The content is not unlawful, misleading, abusive or fraudulent.

You retain ownership of your content but grant YAKA Nation a non-exclusive, royalty-free licence to display, reproduce and use it in connection with operating and promoting YAKA Nation, subject to applicable privacy laws.

We may moderate or remove content that breaches these Terms, applicable law or reasonable platform standards. We will not edit reviews in a way that materially changes the reviewer’s genuine opinion.

13. Intellectual Property

YAKA Nation’s branding, logos, original graphics, photographs, written content and other material owned or licensed by YAKA Nation are protected by applicable intellectual-property laws.

This material may not be copied, reproduced, distributed, modified or commercially used without prior written permission, except where permitted by law.

No ownership or licence is transferred to you through your use of the website or purchase of a product.

14. Acceptable Use

You must not:

  • Use the website for unlawful, fraudulent or harmful purposes.

  • Attempt to gain unauthorised access to the website, customer accounts or connected systems.

  • Introduce viruses, malicious code or other harmful technology.

  • Interfere with the security or operation of the website.

  • Scrape, copy or commercially exploit website content without permission.

  • Misrepresent your identity or payment authority.

  • Use the website to infringe another person’s rights.

We may restrict access where reasonably necessary to prevent misuse, fraud, security threats or unlawful conduct.

Our website is powered by Shopify and may use third-party services for payment processing, delivery, analytics, customer reviews, marketing and other store functions.

Third-party services may be governed by their own terms and privacy practices.

Our website may also contain links to external websites. YAKA Nation is not responsible for external content, availability or privacy practices. A link does not necessarily represent our endorsement of the external website or its operator.

YAKA Nation and Shopify collect, use and disclose personal information as described in our Privacy Policy:

By accessing the website or providing personal information, you acknowledge that you have read the Privacy Policy.

17. Website Availability and Errors

We aim to keep the website accurate, secure and available. However, uninterrupted or error-free access cannot be guaranteed.

We may temporarily restrict access for maintenance, security, technical updates or operational reasons.

If we identify a material error affecting an order, we will contact the customer and provide an appropriate option, which may include confirming the corrected information or cancelling the affected order and issuing a refund.

18. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under Australian Consumer Law.

To the maximum extent permitted by law, YAKA Nation is not responsible for loss caused by:

  • Customer misuse of a product.

  • Inaccurate information supplied by the customer.

  • Unauthorised use of a customer account.

  • Conduct of an independent third party outside our reasonable control.

  • Use of the website in breach of these Terms.

Any limitation in these Terms applies only to the extent permitted by law.

19. Events Outside Our Reasonable Control

Delays or interruptions may occur because of circumstances outside our reasonable control, including severe weather, natural disasters, bushfires, floods, industrial action, government restrictions, transport disruptions, internet failures or Australia Post service interruptions.

Where such circumstances affect an accepted order, we will make reasonable efforts to keep the customer informed and provide an appropriate solution.

Nothing in this section limits any rights or remedies available under Australian Consumer Law.

20. Changes to These Terms

We may update these Terms by publishing a revised version on this website and changing the “Last updated” date.

Changes apply prospectively. They do not alter the terms applying to an order already accepted unless required by law or agreed with the customer.

21. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be interpreted or limited to the minimum extent necessary.

The remaining provisions will continue to apply.

22. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

23. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them, subject to any mandatory rights available under applicable consumer law.
